Over the past weekend, Ray Puzzitiello, BASF Past President, Hall of Famer and Life Director was installed as Secretary – he will ascend to FHBA Presidency in another 3 years! Congratulations, Ray!

Governor Rick Scott addressed the conference of over 200 attendees, highlighting housing’s upswing in jobs and home values….all good news on the South Florida economy.

BASF’s Jeff Spear (The Spear Group) took over the reigns at another most important FHBA Committee, Government Affairs. Conference highlights included the preparation of the Government Affairs Legislative Priorities, with Jeff’s direct guidance.

New FEMA Maps – Coming soon….?

FEMA Map Changes – Pending but not published yet. After discussion with senior County staff, it was confirmed yesterday that FEMA maps will be changing for all Palm Beach County property owners. FEMA Maps are the basis for the Federal governments Flood insurance program and the premiums we all pay for this “must-have” Florida coverage. It is rumored, from those who have seen the maps, that many properties will be reclassified to require more flood protection, which will mean a flood insurance premium increase.

 

No specific date has been published as to when the updated maps will be published. However, County staff advises that, once they are officially released, the public has a 90-day public comment period, to comment and propose amendments. This will give property owners the opportunity to review the maps, and file map amendments if they think their property has been reclassified to an incorrect new (and more expensive) flood zone category.

State Legislative and Regulatory Issues – What’s the latest? Our April Tallahassee lobbying trip both fun and successful!

As some of you are aware, the Florida Home Builders Association held its annual Spring Legislative Conference in Tallahassee. This year’s lobbying trip was very fruitful: the BASF members who participated met with 13 elected officials in two days, attended a highly successful Legislative Reception held at the Governors’ Club, all after having been briefed by Chief Lobbyist and Government Affairs Director, Douglas Buck.

The trip was timed so that we met with legislators just as they were working on the Budget and Appropriations bills, which were 3 of FHBA’s and BASF’s priority issues: 1) funding for career training (Future Builders of America), 2) affordable housing revenue (Sadowski Trust fund) and 3) additional funds for unlicensed contractor enforcement.

Also included in the Association’s top legislative priorities were the following issues: 

  • Support for clarification of certain condominium law provisions
  • Support for certain building code issues, including revamping of energy code issues
  •  Amendment to negative homeowner association bill

Tri-County Regional Issue – Affordable housing.  As the South Florida economy begins to return to a new normal, the issue of affordably priced homes is beginning to reemerge.  Housing prices in the tri-county area are rising, and with it, the renewed concern about additional regulations which could be (re)imposed on builders.  The current situation is as follows: Palm Beach has a mandatory inclusionary zoning ordinance in place, which has not produced much, if any affordable units. In Miami-Dade the process is voluntary, but some applicants offer such units, upon approval. Monroe County has an existing affordable housing program, as does Broward, with details available upon request.

Impact Fee Ordinance adopted at March public hearing – residential fees see no increase – Palm Beach County Impact fee ordinance – new fee schedule was adopted in mid-March public hearing for a mid-May implementation date. Given strong negotiations with BASF and other involved associations, residential fees will NOT increase this year; however, commercial fees will go up some. I can provide some analysis on the fee schedule for those who are interested. Write back in e-mail and I can provide same.

Large numbers of foreclosures nationwide are driving down home values, destabilizing communities, costing jobs and preventing a full-fledged housing and economic recovery.

The lower home values caused by foreclosed homes are also forcing many home owners “underwater” to a situation where they owe more on their mortgage than their home’s current market value. Preventing foreclosures and keeping people in their homes is essential to stabilize home prices, strengthen communities across the land and get the recovery up to full speed.

Appraisals

The large numbers of foreclosures in most areas have inevitably led to numerous problems in the housing market, especially regarding appraisals.

Flawed appraisals are a major problem for home buyers, owners and builders. Too often, appraisers are using distressed properties – many of which have been neglected and are in poor physical condition – as comparables in assessing the value of well-kept existing or brand new homes without accounting for major differences in condition and quality.

Many home owners seeking to refinance and take advantage of today’s record low interest rates are unable to do so because their house appraisals are coming in too low. A move-up buyer is out of luck if the appraisal on their existing home comes in below what they owe on their current mortgage. Likewise, many prospective home buyers have been left out in the cold because their dream house was appraised below the sales contract price. In fact, 60 percent of builders responding to an NAHB member survey in late 2011 reported receiving appraisals on new homes that were lower than the contract sales price, and more than half of the builders reporting that they had encountered this problem said the appraisal amount was less than the cost of construction.

Such appraisal practices are not only unfair and unreasonable, they perpetuate the cycle of declining home values, drive more home owners underwater and act as an obstacle to the recovery of the housing market.

Moreover, the lower property values triggered by foreclosed homes are shrinking the local tax base of many communities. This is putting further pressure on already cash-strapped state and local governments to keep essential services at acceptable levels.

Major reforms in appraisal practices and oversight are needed to ensure that appraisals accurately reflect true market values and don’t contribute to price volatility, impede the economic recovery or harm aspiring home owners and move-up buyers. Based on more than a year of research by a special Appraisal Working Group and extensive input from stakeholder groups, NAHB has published “A Comprehensive Blueprint for Residential Appraisal Reform,” which offers specific recommendations for changes to all aspects of the appraisal system.
